Our ministry to be determined as coordinator association to excute works of in accordance with building materials regulation which numbered 89/106/ EEC of EU within the framework of EU technical regulation with desicion of council of ministry which numbered 97/91196 also pressed on official gazette which numbered 22974 and dated 29th April 1997. In this matter building materials regulation pressed on official gazette which numbered 24870 and dated 08th September 2002 is going to come into effect after 21 months from this date.
However the decision of obligatory application determined on 01th January 2007 for regulations because the reason was defect of basic facilities of comformitiy assesment in our country and having some problems during the applications applicability with european commission. Turkish accreditation Agency (TURKAK) signed multiple recognition contract (MLA) with europena accreditation agency.
(EA) Although the reciprocal recognition has technical basic facilities. Now on the candidates who apply to ministry to purpose of to be accepted establishment, to be examined according to the protocol with TURKAK and sufficiant candidates to change by ministry. The quality assurance economic union (KGS) and Meyer Management and Documentation Service Ltd. Company are examined and qualified by TURKAK. Morever Turkish Standartization Institute (TSE) and Quality Environment Commitee (KCK) examined by European Accreditation Agency and the action of to assign a task broadcasted web site of EU commision and the official gazzette by ministry. However our qualified companies facilities are little in according to this improvements.
In this matter our companies started to do their facilities on January 2007.But still CE marking is required for material groups which is in comprehension of regulation. Manufacturers of all materials has to offer safe products. Concerned legislation safe product has to declare that in using time risk free or have acceptable risk in normal using condition and the product which provides maximum conservancy. Every single material has to be manufacture in accordance to technical arrangement and specifications of building materials regulations. Manufactured product in accordance to concerned technical arrengement and specifications to be accept as safe product. And also to offer this products required to be CE marking according to the law numbered 4703.
Days after 01th January 2007 on the products CE marking is going to be look for market inspection and control according to the regulation. Settled in consistancy with estabished rules of procedures is going to chasten with warning and atonement money according to the law of to prepare technical legislation and application which numbered 4703 and decleration of market inspection and control of building materials. However the point is the manufacturers of building materials after they control their compatibility confirmation if they need certifical association immediately they have to make their applications to the certified associations. The manufacturers who determined to take step about their certifications moreover who proof is with the test results in the technical file which recieved from concerned association is going to be effect minimum and they just have warning from ministry not atonement money.
This kind of warning has not to be effect the manufacturers working with our national association. Days after 08th June 2004 a lot of effort spended about activities of cerfical associations and they supported by ministry.
Latter days according to the belief in sector, asphalt and its components, window, door and a lot of similiar kind of products preparing in the construction site and using them for bulding works therefore there is no need for CE marking. In this matter this vision declared by EU Commision of exploitation general management construction unit. However after all EU Commision is not composing how to make building works. Thats why our national legislation is acceptable and effective. According to the national legislations the materials which is to be use for building works has to be suitable for Turkish standardization organization and they have to have a certificate. Therefore the materials which is using for building works examined according to the test and compatibility.
How the contractors are going to proof their materials compatibility which is going to be use for building works at the construction site or the documents which givent to the manufacturers before the constractors are going to thingk about this matter. However the products for building works never has to be use without any control.
